A lawsuit filed by a candidate in the Jan. 27 All Progressives Congress (APC) gubernatorial primary in Ekiti state, Mr. Kayode Ojo, challenging the victory of governor-elect Mr. Biodun Oyebanji was overturned by a Supreme Court session on Thursday. in Ado Ekiti, Ekiti State.


The court upheld the preliminary objection by Mr. Kabir Akingbolu, Oyebanji’s lawyer, that Ojo’s subpoena and statement of claim were flawed, dealing a fatal blow to the case.

The presiding judge, Judge Babs Kuewumi, dismissed Ojo’s case in a trial Thursday, agreeing with Oyebanji’s attorney that discrepancies in the original proceedings had invalidated the case.
Judge Kuewumi found that the names of the attorneys in the plaintiff’s subpoena and statement, as well as the seal of the Nigerian Bar Association (NBA), were conflicting, which is unlawful and renders the lawsuit flawed and incompetent.
While the name on the NBA seal of one of Ojo’s
attorneys is “Moroof Bolanle,”
the name on the list of attorneys filed for the case is “Olayinka Bolanle.”
A closer examination of the subpoena and the plaintiff’s complaint, the judge said, revealed two different signatures, invalidating the complaint ab initio.
The signatures on the subpoena and the notice of appeal are not identical.There is no jurisdiction, there is no case. I will provide the attorneys with copies of my judgment tomorrow.
“Once the subject matter of the appeal has been decided, no further judgment shall be imposed. The plaintiff is free to appeal to the Supreme Court. ‘ the judge asserted.
